A Federal High Court in Abuja on Monday dismissed the lawsuit filed by Dino Melaye, a senator from Kogi west, challenging the validity of the process of recalling him by his constituents.
INEC Suspends Recall Of Senator Melaye
In his judgment, Justice Nnamdi Dimgba, also directed the Independent National Electoral Commission (INEC) to continue with the process of recalling the senator from the upper legislative chamber.
The Kogi state government had in June claimed that it had recieved the signatures of 188,588 of Melaye’s constituents for his recall from the senate.
It subsequently submitted a catalog of the signatures appended to a petition to INEC.
Following the submission of the petition, INEC fixed August 19 for a verification exercise – to determine if Melaye’s constituents really wanted him out of the upper legislative chamber.

Dimgba described Melaye’s suit as “hasty, premature and presumptuous” as the INEC had already scheduled the exercise for the verification of the authenticity of the signatures in support of the petition being complained about by Melaye.
“He must first go into the verification exercise and only when he does not get justice that he can come to court,” Justice Dimgba ruled.
